Immigration, Sponsorship and Right to Work Training
Employers must adhere to a number of complex rules and requirements in order to ensure that the organisation is protected from civil penalties and other illegal working sanctions. This includes keeping track of Brexit developments concerning EU staff. Those that hold a sponsor licence must also ensure that the sponsor duties are complied with.
All this means that staff who are responsible for immigration compliance must keep on top of new legislation, case law and frequently updated sponsor guidance.
We have trained significant numbers of staff who deal with immigration compliance over many years. This includes personnel at over 50 UK universities and a vast number of UK businesses. Tier 2 and Tier 5 Sponsor Training
Our immigration experts manage sponsor licences for a large number of organisations, including issuing Certificates of Sponsorship and updating the Sponsor Management System as needed. We are also regularly instructed by sponsors that have received a sponsor licence suspension notice from UKVI and we have had considerable success in persuading UKVI to reinstate the licence.
We draw on this expertise when training organisations on best practice. We cover a number of key areas such as compliance with the Tier 2 and 5 sponsor duties, how to perform a compliant Resident Labour Market Test, choosing the most appropriate Standard Occupational Classification (SOC) code, how to issue Certificates of Sponsorship and recent case law.
We also cover the process for those applying for entry clearance or leave to remain under Tier 2 (General), Tier 2 (ICT) or Tier 5 (if relevant). This enables those who are responsible for the organisation’s sponsor licence to gain an in-depth understanding of the immigration application process and requirements for employees and their family members.

We also offer training to cover other potential immigration options for business owners, directors, employees, interns, consultants and others involved with the business including, for example, Tier 1 (Entrepreneur), Tier 1 (Exceptional Talent), Representative of an Overseas Business, Tier 5 and Business Visitors. We are able to provide detailed information about the application process, conditions and limits of these immigration routes.
Increasingly, we are also providing training to businesses on Brexit immigration related implications for EEA staff and their family members including applications under the EU Settlement Scheme.
Right to Work Training
Our training on Right to Work compliance covers the best practice and fast-changing case law on this subject. Our experts have successfully defended many businesses that have received a Civil Penalty notice. Our training provides practical tips on the prevention of illegal working legislation, right to work checks as well as training on how to avoid or reduce a civil penalty for illegal employment.
