On-site Sponsor Compliance Review
Sponsors must follow the duties outlined in the Sponsor Guidance. Failure to do so can lead to action from UKVI, including the suspension or revocation of the sponsor licence. The Sponsor Guidance is updated frequently and is both extensive and complex. As such, a sponsor should review its practices and policies regularly to ensure they are compliant with the Sponsor Guidance.
UKVI may perform a sponsor compliance inspection as part of a new sponsor licence application, as part of a sponsor licence renewal application or at any time throughout the period in which the organisation holds a sponsor licence. The purpose of UKVI’s review is to determine whether or not the organisation is complying, or capable of complying, with the sponsor duties.
Inspections may be undertaken by way of a visit to the sponsor, which may be announced or unannounced, and/or via other means such as requesting that the sponsor provides specific information to UKVI by email and/or by undertaking checks with third parties such as HMRC.
If your organisation is due an inspection from UKVI, or the organisation wants to check its compliance, we offer a remote or on-site, sponsor compliance review service.
On-site Sponsor Compliance Review: How our immigration solicitors can help
When carrying out an on-site compliance review, members of our team will visit your organisation to review your current/proposed practices and policies and carry out a mock UKVI compliance review. We will interview those who are or who will be key personnel on the licence and advise on any areas of concern or any areas that require improvement.
Our immigration experts will compare the organisation’s practices and policies with the latest guidance and information from the Home Office, as well as drawing on their own knowledge of working with sponsors, including successfully assisting sponsors that have been investigated by UKVI for compliance breaches. We can also incorporate into our visit a training session on sponsor compliance if preferred.
In-depth feedback can be given to sponsors on the day of the on-site compliance review and we can also prepare a detailed report.
